Acceptable Use Policy

1. Introduction
This Acceptable Use Policy (“AUP”) sets out the rules for acceptable and prohibited use of the website of PROCEKA TechSol Private Limited (“PROCEKA”, “we”, “us”) at https://www.proceka.com (the “Website”), and any future digital services we introduce, including client or professional dashboards, AI-assisted features, SaaS applications, marketplace services, mobile applications, and APIs (together, the “Services”). This AUP integrates with, and should be read alongside, our Privacy Policy, Website Terms & Conditions, Service Engagement Terms & Conditions, Cookie Policy, Refund Policy, and Disclaimer.
2. Purpose
The purpose of this AUP is to protect PROCEKA’s digital infrastructure, protect other users of the Services, prevent misuse, and provide clear operational rules that support the responsible use of the Website today and any future digital services we introduce.
3. Scope
This AUP applies to anyone who accesses or uses the Website or Services, including visitors, individuals submitting enquiries or bookings, and, in future, registered users of any client or professional dashboard, marketplace, or application we introduce.
4. Definitions
“User” or “you” means anyone accessing or using the Website or Services. “Content” means any material available through the Services, including PROCEKA’s own Content and, where applicable in future, User Generated Content. “Account” means any future login-based access to a client dashboard, professional dashboard, or similar feature.
5. Acceptance of Policy
By using the Website or Services, you agree to comply with this AUP. Where a future feature requires separate acceptance (such as account registration), that acceptance will incorporate this AUP by reference.
6. Acceptable Use
You may use the Website and Services for their intended purposes: to learn about PROCEKA’s services, submit genuine enquiries, book consultations, make legitimate payments, access downloadable resources for your own reference, and, in future, use any client or professional dashboard, AI-assisted feature, or application strictly for its intended business purpose.
7. User Responsibilities
You are responsible for the accuracy of information you submit, for your own conduct while using the Services, and, where applicable in future, for activity that occurs under any Account associated with you.
8. Account Security
The Website does not currently require user accounts. If PROCEKA introduces Accounts in the future (for example, for a client or professional dashboard), you will be responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account, and must notify us promptly of any suspected unauthorised access.
9. Password Responsibilities
Where Accounts are introduced in the future, you will be responsible for choosing a reasonably secure password, keeping it confidential, and not sharing it with unauthorised persons. PROCEKA will never ask you for your password directly.
10. Lawful Use
You agree to use the Website and Services only for lawful purposes and in compliance with applicable Indian law, including the Information Technology Act, 2000 and, where relevant to unlawful online conduct, the Bharatiya Nyaya Sanhita.
11. Respectful Behaviour
You agree to interact respectfully with PROCEKA staff and other users of the Services, including during consultations, correspondence, and, in future, any community or portal features.
12. Intellectual Property
You must respect PROCEKA’s intellectual property rights, as described in our Website Terms & Conditions, and must not reproduce, distribute, or exploit Website Content without authorisation.
13. Downloads
Downloadable resources made available on the Website are for your own reference and internal use. You must not redistribute, resell, or misrepresent downloadable resources as your own original work.
14. Communication Rules
Communications with PROCEKA, whether by form, email, phone, or, in future, portal messaging, should be genuine, relevant, and respectful. Abusive, threatening, or harassing communication is not permitted.
15. User Generated Content
The Website does not currently accept user-generated content such as reviews or public posts. If such a feature is introduced in future (for example, in a marketplace or community feature), you will be responsible for content you submit, and it must comply with Sections 32 to 35 of this AUP.
16. AI Services Usage
Where AI-assisted features are introduced (as described on our Technology & AI Solutions page), you must use them only for their intended purpose, must not attempt to manipulate them to produce unlawful, misleading, or harmful output, and should not treat AI-generated output as final professional advice without review by a qualified PROCEKA professional, consistent with our Disclaimer.
17. Professional Conduct
Where you engage with PROCEKA professionals directly (for example, during a consultation or ongoing engagement), you agree to conduct yourself professionally and to provide accurate information, consistent with our Service Engagement Terms & Conditions.
18. Client Portal Usage
If PROCEKA introduces a client dashboard in the future, it must be used only to manage your own engagements and information, and not to attempt to access information belonging to other clients.
19. Professional Portal Usage
If PROCEKA introduces a professional portal or marketplace in the future, participating professionals must comply with any additional conduct and verification requirements presented at that time, in addition to this AUP.
20. Payment Usage
You must use the Website’s payment functionality only to make genuine, authorised payments for your own transactions. Attempting to make fraudulent, unauthorised, or duplicate payments in bad faith is prohibited.
21. Consultation Booking
You must provide accurate information when booking a consultation and must not make repeated bad-faith bookings without genuine intent to attend, as this affects availability for other users.
22. Document Upload
Where you share documents with us, you must ensure you have the right to share that content, and must not upload or transmit files containing malware or unlawful material, as further described in Sections 23 and 34.
23. Malware
You must not upload, transmit, or attempt to introduce viruses, ransomware, or any other malicious code to the Website or Services.
24. Hacking
You must not attempt to gain unauthorised access to the Website, Services, or any related system or account, including through password attacks or exploitation of vulnerabilities.
25. Reverse Engineering
You must not reverse engineer, decompile, or attempt to extract the source code of the Website or any future application or platform, except where expressly permitted by applicable law.
26. Automated Scraping
You must not use bots, automated scripts, or scraping tools to extract Content or data from the Website, except where expressly permitted (such as standard search engine indexing).
27. Spam
You must not use the Website or Services to send spam, chain messages, or unsolicited bulk communications, including through contact or consultation forms.
28. Fraud
You must not use the Website or Services for fraudulent purposes, including fraudulent payments, false representations to obtain services, or any other deceptive conduct.
29. Identity Misrepresentation
You must not misrepresent your identity, qualifications, or authority to act on behalf of an organisation when using the Website or Services.
30. Impersonation
You must not impersonate PROCEKA, its staff, or any other person or entity when using the Website or Services.
31. Abuse of Staff
Threatening, abusive, or harassing behaviour towards PROCEKA staff, whether in person, by phone, email, or through the Website, is not tolerated and may result in suspension of services as described in Section 39.
32. Defamation
You must not use the Website or any future user-generated content feature to publish defamatory statements about PROCEKA, its staff, or third parties.
33. Offensive Content
You must not submit or transmit content that is offensive, hateful, discriminatory, or otherwise inappropriate through the Website or Services.
34. Illegal Content
You must not use the Website or Services to upload, transmit, or promote unlawful content, including but not limited to content promoting terrorism, gambling where prohibited, money laundering, or any other illegal activity under Indian law.
35. Copyright Violations
You must not upload, share, or transmit content through the Website or Services that infringes the copyright or other intellectual property rights of PROCEKA or any third party.
36. Data Extraction
You must not attempt to extract, harvest, or compile data from the Website or Services beyond your own personal or authorised business use, including personal information of other users where applicable in future.
37. Security Testing
You must not conduct penetration testing, vulnerability scanning, or other security testing of the Website or Services without PROCEKA’s prior written authorisation. Suspected vulnerabilities should be reported responsibly as described in Section 42.
38. Third Party Services
Where your use of the Website involves third-party services (such as our payment gateway), you must also comply with the applicable third party’s own acceptable use terms, where disclosed.
39. Suspension of Access
PROCEKA may suspend or restrict your access to the Website or Services, without prior notice where reasonably necessary, if we reasonably believe you have violated this AUP, engaged in unlawful conduct, or where required by law or professional obligation.
40. Permanent Termination
For serious or repeated violations of this AUP, PROCEKA may permanently terminate your access to the Website or Services. This does not affect any separately agreed professional engagement, which is governed by its own terms unless separately terminated.
41. Investigation of Violations
PROCEKA may investigate suspected violations of this AUP, including reviewing relevant activity and information reasonably necessary to assess the matter, in accordance with our Privacy Policy.
42. Reporting Abuse
If you become aware of a violation of this AUP, a security vulnerability, or misuse of the Website or Services, please report it to us using the contact details in Section 46. We take reports seriously and will assess them appropriately.
43. Changes to Policy
We may update this AUP from time to time to reflect changes in our services, technology, or applicable law. The “Effective Date” below indicates when this AUP was last revised. Nothing in this AUP removes or reduces any statutory rights you may have under applicable Indian law, including the Consumer Protection Act, 2019.
44. Governing Law
This AUP is governed by the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Consumer Protection Act, 2019 where applicable, without regard to conflict of law principles.
45. Jurisdiction
Subject to applicable law, any disputes arising out of or relating to this AUP shall be subject to the exclusive jurisdiction of the competent courts at Keonjhar, Odisha, India.
