Privacy Policy
Effective Date: 24 July 2026
1. Introduction
PROCEKA TechSol Private Limited (“PROCEKA”, “we”, “us”, or “our”), a company incorporated in India with its registered office at Rajabandha, Ghatgaon, Keonjhar, Odisha, India, is committed to protecting the privacy of individuals who visit our website at https://www.proceka.com (the “Website”) or engage our services. This Privacy Policy explains what information we collect, why we collect it, how we use and protect it, and the choices and rights available to you.
2. Scope
This Policy applies to personal information collected through the Website, our consultation booking and payment processes, direct communications with us (email, phone, forms), and any future digital products or services we may launch, including but not limited to mobile applications, client or professional dashboards, document upload and sharing tools, AI-assisted features, and any future SaaS platform or professional marketplace. Where a future service requires materially different data practices, we will update this Policy or issue a supplementary notice before that service becomes available.
3. Definitions
In this Policy: “Personal Information” means any information that identifies or can reasonably be used to identify an individual. “Sensitive Personal Data” has the meaning given under applicable Indian law, including financial information, and (where applicable) government identification details. “Data Fiduciary” and “Data Principal” have the meanings assigned under the Digital Personal Data Protection Act, 2023. “Processing” means any operation performed on Personal Information, including collection, storage, use, disclosure, and deletion. “Service Provider” means a third party that processes information on our behalf under contractual obligations.
4. Acceptance of Policy
By using the Website, submitting an enquiry, booking a consultation, or making a payment through the Website, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, please do not use the Website or submit personal information to us. Where a specific service requires explicit consent under applicable law, we will seek that consent separately.
5. Information We Collect
We collect information in three broad ways: information you provide directly to us, information collected automatically through your use of the Website, and information received from third parties such as payment processors, in the limited circumstances described below.
6. Personal Information
Depending on how you interact with us, we may collect: your name, mobile number, email address, organisation name, mailing address, and details you provide in enquiry, consultation, or payment forms (such as the nature of your requirement, preferred consultation category, and preferred date or time). We collect only what is reasonably necessary for the purpose for which it is submitted, and we do not intentionally collect personal information beyond that purpose.
7. Sensitive Information
Where our services require it — for example, financial, taxation, or compliance advisory — you may choose to share sensitive business, financial, or identification information with us directly (such as by email or during a consultation), outside of standard Website form fields. We do not request such information through general enquiry forms. You should avoid submitting highly confidential documents or data through unencrypted channels such as standard email unless we have specifically requested it and confirmed an appropriate secure method.
8. Business Information
Where you engage us on behalf of a business, trust, society, or other organisation, we may collect the organisation’s name, registration details, and related business information reasonably necessary to deliver the requested service.
9. Technical Information
We may automatically collect technical information when you visit the Website, including your IP address, browser type and version, device type, operating system, referring website, pages visited, and the date and time of your visit. This information helps us maintain Website security, diagnose technical issues, and understand aggregate usage patterns.
10. Device Information
If you access the Website using a mobile device, we may collect device-specific information such as device model, operating system, and unique device identifiers, to the extent your device or browser makes this available and where relevant future mobile applications require it.
11. Cookies
The Website uses cookies and similar tracking technologies to operate correctly, remember your preferences, and understand how visitors use the Website. Cookies are small text files stored on your device. We use essential cookies (required for core Website functionality), and may use analytics cookies (see Section 12) and preference cookies. You can control or disable cookies through your browser settings; disabling essential cookies may affect Website functionality. Further detail is available in our separate Cookie Policy.
12. Analytics
We may use third-party analytics tools (such as Google Site Kit / Google Analytics and Microsoft Clarity, where enabled) to understand aggregate Website usage, such as which pages are visited and how visitors navigate the Website. These tools may set their own cookies and process technical information as described in Section 9. We use analytics data in aggregate or pseudonymised form to improve the Website and do not use it to make automated decisions that produce legal or similarly significant effects concerning you.
13. Marketing Preferences
If you subscribe to a newsletter or opt in to receive updates from us, we will use your email address for that purpose only, in accordance with the preference you indicated. You may unsubscribe at any time using the link provided in any marketing email, or by contacting us directly. We do not sell or rent your contact details to third parties for their own marketing purposes.
14. How Information Is Used
We use the information we collect to: respond to enquiries and consultation requests; schedule and deliver consultations and professional services; process payments and issue related confirmations or receipts; maintain and improve the Website; comply with applicable legal, tax, and regulatory obligations; detect and prevent fraud, abuse, or security incidents; and, where you have opted in, send marketing communications.
15. Legal Basis
Where applicable law requires a specified legal basis for processing, we rely on one or more of the following: your consent (for example, when you submit a form or subscribe to a newsletter); the necessity of processing to take steps at your request prior to entering into an engagement, or to perform an engagement with you; compliance with a legal obligation (such as tax or regulatory recordkeeping); and our legitimate interests in operating, securing, and improving the Website and our services, balanced against your rights.
16. Information Sharing
We do not sell your personal information. We may share information with: Service Providers who process data on our behalf (see Section 17); professional advisors where necessary to deliver a specific engagement; regulatory or government authorities where required by law; and any successor entity in the event of a merger, acquisition, or sale of business assets, subject to that entity being bound by materially similar privacy commitments.
17. Service Providers
We engage third-party service providers to support Website and business operations, including web hosting, payment gateway processing, email delivery, and website security services. These providers are permitted to process your information only as necessary to provide their service to us and are not authorised to use it for their own independent purposes.
18. Payment Processing
Payments made through the Website are processed by PayU, a licensed third-party payment gateway. Card, UPI, and banking credentials you enter during payment are collected and processed directly within PayU’s secure environment; PROCEKA does not receive, view, or store your full card or banking credentials, except to the limited extent legally required (for example, transaction reference information for accounting and regulatory purposes).
19. Consultation Services
When you book a consultation, we collect the details you provide (such as your name, contact details, organisation, consultation category, and a description of your requirement) to identify the appropriate advisor and prepare for the engagement. This information is retained as part of our client records in accordance with Section 28.
20. AI Features
Where we introduce AI-assisted features in the future (for example, AI-assisted documentation, research assistance, or knowledge search, as described on our Technology & AI Solutions page), any personal or business information processed by such features will be handled in accordance with this Policy, and any AI-generated output involving client-specific advice will be reviewed by a qualified professional before being relied upon. We will update this Policy with additional detail before any such feature that materially changes how personal information is processed becomes generally available.
21. User Accounts
The current Website does not require user account registration. If we introduce user accounts in the future (for example, for a client dashboard), we will collect the information necessary to create and secure that account (such as name, email, and a password or authentication credential), and will update this Policy accordingly before such accounts become available.
22. Client Dashboards
Any future client dashboard would display information relevant to your engagement with us, such as service status, documents, and communications. Access would be restricted to authenticated users, and any such feature will be described in a future update to this Policy prior to launch.
23. Professional Accounts
If we launch a professional marketplace or network in the future, professionals registering with PROCEKA may be asked to provide verification information (such as professional credentials or registration numbers) in addition to standard contact details. This section will be expanded with specific detail before any such feature launches.
24. Document Uploads
Where you share documents with us (currently via email or direct communication, and potentially via a future upload feature), those documents may contain personal or confidential business information. We handle uploaded or shared documents using reasonable administrative and technical security measures appropriate to their sensitivity, and access is limited to personnel who need it to deliver the relevant service.
25. File Retention
Documents and files you share with us are retained for as long as necessary to deliver the relevant service and to meet our legal, tax, and regulatory recordkeeping obligations, after which they are securely deleted or anonymised, subject to any longer retention period required by law.
26. Communication
We may contact you by email, phone, or (where you have provided a number and it is available) WhatsApp or text message, regarding your enquiry, consultation, or engagement, and, where you have opted in, for marketing purposes. You may request that we limit or stop non-essential communications at any time.
27. Security Measures
We take reasonable administrative, technical, and organisational measures designed to protect personal information against unauthorised access, alteration, disclosure, or destruction, including the use of HTTPS encryption for Website traffic, restricted access to systems containing personal information, and the use of reputable, security-conscious service providers. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You share information with us at your own risk, and we encourage you to take reasonable precautions when transmitting sensitive information.
28. Data Retention
We retain personal information for as long as necessary to fulfil the purposes described in this Policy, including to provide services, comply with legal and regulatory obligations (such as tax and accounting recordkeeping requirements under Indian law), resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected.
29. User Rights
Subject to applicable law, including the Digital Personal Data Protection Act, 2023, you may have the right to: request access to the personal information we hold about you; request correction of inaccurate or incomplete information; request erasure of your personal information, subject to our legal and legitimate business retention needs; withdraw consent where processing is based on consent, without affecting the lawfulness of processing before withdrawal; and register a grievance regarding our handling of your personal information. To exercise these rights, please contact us using the details in Section 40.
30. Children's Privacy
The Website and our services are intended for use by adults and businesses. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child without appropriate consent, we will take steps to delete it.
31. Cross-Border Transfers
Our operations and service providers are currently based in India, and we do not currently transfer personal information outside India in the ordinary course of business. If we engage international service providers or expand operations overseas in the future, any cross-border transfer of personal information will be carried out in accordance with the requirements of applicable Indian law at that time, and this Policy will be updated accordingly.
32. Third-Party Websites
The Website may contain links to third-party websites (for example, social media platforms or resource references). We are not responsible for the privacy practices or content of third-party websites, and we encourage you to review their privacy policies independently.
33. Intellectual Property
All content on the Website, including text, graphics, illustrations, and design elements, is the property of PROCEKA TechSol Private Limited or its licensors and is protected by applicable intellectual property laws. This Policy does not grant you any rights to use our intellectual property beyond what is necessary to browse the Website in the ordinary course.
34. Confidentiality
Information you share with us in the course of a professional engagement is treated as confidential and handled in accordance with applicable professional confidentiality standards, in addition to the protections described in this Policy. Confidentiality obligations survive the conclusion of an engagement, subject to any disclosure required by law.
35. Cookies Policy Reference
Detailed information about the specific cookies used on the Website, their purpose, and how to manage your preferences is set out in our separate Cookie Policy, available on the Website.
36. Data Breach Response
In the event of a personal data breach that poses a risk to your rights and interests, we will take reasonable steps to investigate and contain the breach, and will notify affected individuals and relevant regulatory authorities where required under applicable law, including the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.
37. Limitation of Liability
While we take reasonable steps to protect personal information as described in this Policy, PROCEKA TechSol Private Limited shall not be liable for any loss or damage arising from unauthorised access, use, or disclosure of personal information that occurs despite our reasonable security measures, including where such loss arises from circumstances beyond our reasonable control, to the fullest extent permitted by applicable law.
38. Indemnity
You agree to indemnify and hold PROCEKA TechSol Private Limited harmless from any claims, losses, or damages arising from your breach of this Policy, your misuse of the Website, or your submission of inaccurate or unauthorised information through the Website.
